1948 Case - GGM - GF - M - Me
I've recently started looking into if I qualify through my great grandparents as they were both born in Italy.
GGF (1887-1973) - Arrived in New York 1913 -- Naturalized 1919
GGM (1895-1990) - Arrived in New York 1920 -- Naturalized 1920 (involuntarily through marriage)
GF - (1923-1922) - Born In New York
When I started digging into this a few weeks ago, I thought I hit the end of the line once I saw the census saying they were both naturalized. I couldn't shake the feeling I was wrong in giving up just based on that, so I started doing more research this week, and discovered I still most likely have a path through my GGM (1948 case). It would be my only potential path.
From what I have understood from my research, because my GGM naturalized involuntarily through marrying my GGF, the Italian government still considered her an Italian citizen. The only issue would be if she petitioned for naturalization on her own. My assumption is that naturalizing through marriage would have been enough for someone since the U.S. saw them as citizens. Would there be any logical reasons she would petition herself? I know no one here can say for sure.. I am just trying to figure out potential roadblocks.
Since this whole process feels overwhelming, I am trying to get my ducks in a row and an organized tracker of the documents I will need since I have to start with nothing in hand. Am I correct in thinking I need to request a CoNE from USCIS? I've recently seen in a group that someone had received a letter from USCIS stating the GGM was naturalized by marrying the GGF, so they didn't provide an official CoNE, and the judge in Italy ruled that was not sufficient evidence that the GGM did not naturalize. Their Italian lawyer is a appealing, but it will add another 6 months to the case. Since I am assuming that is the type of letter I would receive, it had me worried I may need some other type of document? Would NARA have a letter stating my GGM didn't naturalize on her own? Would I also need my GGF certificate of naturalization through NARA?
Like I said, I am at the very beginning stages of this, so I am trying to get everything organized as much as I can so I don't hold up the process since it's already a long one. I really appreciate any insight or advice! :)
