How do you choose what case to cite when you’re citing to a basic rule that there’s no dispute about and is discussed in umpteen cases? (e.g., the elements of X are, X is a question of law, etc.)
Highest court? Most recent decision? Most analogous facts? Most favorite wording? First one you find? One where OC was on the losing end?
(This is mostly out of curiosity and not really seeking advice unless the answers reveal I’m doing something vastly wrong)
